II. SITE SCOPE
These Terms and Conditions of Use (the "Terms of Use") define the conditions of access and use of the Site which we make available to you free of charge, without remuneration to Legrand, for your private use.
To use the Site, you must first accept the Terms of Use. We invite you to read them carefully. By accepting the Terms of Use, you (i) acknowledge that you have read and understood the Terms of Use, and (ii) accept and agree that the Terms of Use shall constitute a contract between the user of the Site (you) and Legrand, describing the rights and obligations of each party with respect to the Site.
For the avoidance of doubt, the Terms of Use apply only to employees of Legrand, acting on their own behalf.
III. INTELLECTUAL PROPERTY RIGHTS
Legrand is the exclusive owner of all intellectual property rights relating to the Site (including, without limitation, patents relating to the Site, rights in the object code and source code of the Site and all trademarks and logos, text, layouts, visuals, photographs, graphics, icons, and all other distinctive elements contained in the Site and all copyrights relating to the Site more generally).
The Terms of Use do not entail any transfer of ownership or intellectual property rights to you. Subject to the terms defined in the Terms of Use. For the avoidance of doubt, you are reminded that use of the Site must be limited to your personal needs and may under no circumstances be exploited for commercial purposes or for any purposes other than those described in the Terms of Use. You commit to ensure that your use of the Site in no way infringes the intellectual property rights of Legrand or third parties.
IV. PERSONAL DATA AND COOKIES
When you visit the Site, information relating to your navigation may be recorded in "cookie" files placed on your terminal. A cookie is a file placed on your terminal which records information relating to your navigation on a website. The personal data collected in this way is intended to facilitate subsequent browsing of the said website and to enable various traffic measurements to be taken. V. AVAILABILITY OF SERVICES AND LIABILITIES
A. Availability of services
Subject to the provisions of the Terms of Use (in particular the paragraph below), Legrand grants you continued access to the Site. Legrand has implemented appropriate measures to ensure the proper operation and security level of the Site and undertakes to carry out regular checks to maintain this state.
From time to time, Legrand may suspend access to the Site in order to carry out technical maintenance, migration or updating operations. If necessary, an information banner on the Site will inform you of this interruption.
For all practical purposes, it is specified that Legrand cannot be held liable for this type of interruption and that no compensation will be paid in such cases.
B. Liability
Legrand shall not be liable for any loss or damage you may suffer only to the extent that such loss or damage results from a breach by Legrand of its obligations under the Terms of Use. The extent of its liability, if necessary, shall be determined in accordance with applicable law.
In the light of the foregoing principle and for the avoidance of doubt, Legrand cannot be held liable for any breach of its obligations where such breach results from:
- an act on your part (such as your use of the Site in breach of the Terms of Use);
- the act of a third party not acting under the control of Legrand, when this act is unforeseeable at the date of creation of your account and insurmountable (such as, if the conditions are met, an interruption in access to the Site caused by the failure of an Internet service provider or by a technical problem with your electronic equipment);
- an event of force majeure as defined in article 1218 of the French Civil Code and interpreted by the French courts. For your complete information, an event of force majeure corresponds, in our case, to an event beyond our control, which could not be reasonably foreseen at the time of the conclusion of this contract with Legrand, whose the effects of which cannot be avoided by appropriate measures, and which prevents us from performing our obligations under the Terms of Use. Provided that they meet the above conditions, the following events will constitute force majeure events (non-exhaustive list): fires, exceptional climatic events, floods, explosions, wars, civil unrest, strikes, epidemics or pandemics , the stoppage of energy supplies, electrical and electromagnetic phenomena that disrupt mobile networks, a large-scale computer attack, a legislative or regulatory change or any other mandatory decision by a public authority that would prevent us from providing or would have an impact on the provision of the Site and the supply of related services.
For the avoidance of doubt, this clause is not intended to limit your rights and remedies available under applicable law. In the event of any loss or damage caused by Legrand resulting from a breach of the Terms of Use, you may exercise the rights and remedies provided in the Terms of Use and/or under applicable law.
VI. TERMS AND CONDITION OF USE
Legrand grants you a right to access and use the Site. This right is granted subject to your compliance with the Terms of Use, as well as any laws and regulations that may apply to you when you access and use the Site.
The costs associated with the equipment and means enabling access to the Site (including telecommunications costs) are at your sole expense.
In accessing and using the Site, you agree to:
- not to use this Site in a way that may infringe the rights of others, such as other users of the Site;

For all intents and purposes, the failure or delay in exercising any right or remedy in the event that you breach the terms of the Terms of Use shall not constitute a waiver by Legrand of any subsequent exercise of such right or remedy or of any other right or remedy that Legrand may otherwise have.
In the event that you fail to comply with the Terms of Use - in particular, if you engage in any of the prohibited conduct identified above - or, more generally, if you commit any breach of applicable laws and regulations in connection with your access to and use of the Site - we reserve the right to take any action against you to recover any loss or damage that may be caused.
VII. CHANGES TO THE WEBSITE AND THE TERMS OF USE
Legrand may modify the Terms of Use and/or the Site to take account of technical or regulatory developments, without this leading to any change in the quality of the services offered by the Site, its essential characteristics, or any change concerning free access to the Site (i.e. without any financial consideration for Legrand).
VIII. DIVISIBILITY - EFFECT OF THE NULLITY OF A CLAUSE
If any provision of the Terms of Use, or any part thereof, is or becomes null and void, ineffective, unwritten or unenforceable, all other provisions agreed between Legrand and you shall remain in full force and effect.
IX. APPLICABLE LAW - DISPUTE RESOLUTION AND JURISDICTION
The Terms of Use, and, more generally, the terms and conditions of access and use of the Site, are governed by and construed in accordance with French law.
In the event of a dispute or claim, we are always willing to try to find an amicable solution before taking any legal action.
In the event that you decide to initiate legal proceedings relating to the existence, interpretation, conclusion, performance or termination of the contract concluded with Legrand on the basis of the Terms of Use, you may bring such proceedings before the competent courts of France.
